A court has sent 104-year-old Nur Mohammad, who was sentenced to 10 years in prison in a robbery and double murder case committed two decades ago in Kishoreganj, to jail.
On Tuesday, September 8, he surrendered before the Fourth Speedy Trial Tribunal of Dhaka and applied for bail, which was rejected, and he was ordered to be sent to prison.
Lawyer Faisal Ahmed applied for bail on behalf of Nur Mohammad on the condition of an appeal in the court of Tribunal Judge Farjana Yasmin. Bench Assistant of the court Mizanur Rahman confirmed this information.
He said that considering his age and illness, Nur Mohammad had sought permission to go to prison by transport at his own expense. However, the court did not accept that application either.
In court, Nur Mohammad's lawyer said that his client is 104 years old. He cannot move normally and has to take regular treatment and medication. This person, suffering from various complex diseases, voluntarily surrendered to the court. For this reason, bail was sought on the condition of an appeal.
According to case documents, on the night of December 30, 2000, a robbery took place at Ferdous's shop in the Bara Bazar area of Kishoreganj. At this time, two people named Mosharraf Hossain and Abdul Kabir were killed. The robbers looted about Tk 1.25 million and 110 bhori of gold from the shop's safe.
Following the incident, shop owner Ferdous filed a case at Kishoreganj Police Station. After investigation, the then Sub-Inspector (SI) Anwar Hossain of Kishoreganj Police Station submitted a chargesheet to the court against 14 accused on February 13, 2002.
Later, charges were framed against the accused and trial began. The case was subsequently transferred from Kishoreganj to the Speedy Trial Tribunal of Dhaka for trial. After recording the testimony of 13 people during the trial, the Fourth Speedy Trial Tribunal delivered its verdict on November 16, 2003.
At the time of the verdict, Habibur Rahman Habib, Shah Alam, Moin Uddin alias Moin Uddin, Nur Mohammad, Alam, Dilu alias Delwar Hossain, Shukkur Ali, and Altu Mia were sentenced to death.
On the other hand, Jasim, Siddik, Amir Chan, Kabir, and Bazlur Rahman were sentenced to imprisonment for life along with a fine of Tk 5,000 each. In default of the fine, they were ordered to suffer another year of rigorous imprisonment. During the trial, an accused named Haris Mia died.
Subsequently, after the hearing of the death reference and appeals, the High Court upheld Alam's death sentence on August 19, 2007. The sentences of the other accused were also modified to various terms. At that stage, Nur Mohammad's sentence was reduced to 10 years' imprisonment.
According to case documents, Nur Mohammad had given a confessional statement in court admitting guilt to the murder in this case. Later, taking bail from the court, he went into hiding. He was even a fugitive at the time of the delivery of the case verdict.
After a long time, on Tuesday, he appeared in court and surrendered. However, even though bail was sought highlighting his age and illness, the court rejected it and ordered him to be sent to jail.
